GENERAL TERMS AND CONDITIONS OF SALE

These terms and conditions govern the contract of sale and purchase between the purchaser of the online store alfaparts.it (hereinafter referred to as ‘Purchaser’) and

  1. 1. Content of the general conditions of sale. The following general conditions of sale govern all contracts of sale concluded between the Buyer and the Seller through the website alfaparts.it. Each contract is subject to the general terms and conditions of sale published on the site at the time the contract is concluded (see art.3).When we talk about ‘Buyer’ we refer to any natural and/or legal person who acts on alfaparts.it with purposes not referable to his or her commercial, entrepreneurial or professional activity, possibly carried out. If you are not a ‘Buyer’, please refrain from entering into commercial transactions on alfaparts.co.uk. Any modification proposed by the Buyer is not suitable to vary the general conditions of sale, unless expressly accepted in writing by the Seller.
  2. 2. Parties to the contract and geographical area The online store alfaparts.it is intended for the exclusive use of consumers, that is, it is reserved for retail sale. Complaints regarding the site and delivery to the Final Buyer’s home should be addressed to the Seller. Products offered for sale through alfaparts.co.uk will be delivered to Buyers who indicate a location located in Italy as their delivery address. Contract Perfection: All product information on alfaparts.it, such as technical specifications, images, dimensions or compatibility details are not binding and are subject to change at any time unless expressly identified as binding. In the event that the Buyer in the purchase is misled by the aforementioned indications, the Buyer may exercise the right of withdrawal set forth in the paragraph Right of Return and Withdrawal. Offers on store alfaparts.it are not binding on the Seller and do not constitute an offer to the public, but merely ‘invitatio ad offerendum’.
    The Buyer’s Purchase Order has the value of a binding contractual proposal. The Purchase Order is accepted by the Seller with an Order Receipt sent by e-mail, which contains an excerpt of the conditions of sale, a description of the characteristics of the ordered product, the essential elements of the contract (price, payment method), the systems set up by the Seller for storing the order, the procedures for shipping the product. The contract is finalized and becomes effective when the Buyer receives the Order Receipt. The Order and Order receipt are considered received when the parties to whom they are addressed have the ability to access the telematic messages. In the event that Buyer does not receive an Order Receipt from Seller or other communication from Seller within 24 hours of placing the Order, Buyer should promptly contact Seller through the address: info@blackparts.it.

Purchase of Products The Products displayed in the Catalogue may be purchased by means of the prior selection of the same by the Buyer and the subsequent insertion of the same in the appropriate shopping cart. Once the selection of Products has been completed and wishing to proceed with the purchase of those placed in the shopping cart, the Buyer will be asked to leave details in order to allow the Contract to be finalized. In particular, personal data, e-mail address, address as well as the address where to deliver the Products (if different from the first), your billing address will be required.
  5. In the case of payment by “Pay Pal”, the amount of the purchase will be charged to the Buyer after the conclusion of the order on the site.
  6. In the case of payment by bank transfer, please want to wait for the order confirmation that the Seller will issue within 16 working hours after receipt of the order with also indicated the assumed dates of order fulfillment.

The Seller does not guarantee the actual existence in stock of the products listed onalfaparts.co.uk and/or the correct quality of the same, which quality will be verified at the time of shipment. The Seller reserves the right to accept the Buyer’s purchase proposal upon verification of stock availability. It is understood that if it is not possible to fulfill Buyer’s order, Seller will promptly notify Buyer that Buyer will have the option to cancel the Purchase Agreement and any payment already made by Buyer will be refunded without further delay.

Upon receipt of the goods, the Buyer should immediately check that the delivery is complete and correct and promptly inform the Seller of any problems by writing to info@blackparts.it.
  • 6. Pricing and Shipping CostsThe price of the Products shall be as set forth in the Price List posted on the Site on and before the Order is issued.
  • 7. Payments Orders placed on store.blackparts.co.uk can be paid by “Pay Pal”.
    The Seller may allow additional payment methods in the payment section on alfaparts.it
  • 8. Warranty
    1. 8.1 Seller’s legal warrantyThe Seller shall issue pursuant to and for the purposes of Directive 44/99/EC a legal warranty on the product for non-conformity of the same to the qualities envisaged in the sales contract, in compliance with applicable legislation.The warranty allows the Buyer, in case of non-conformity defects of the product, to obtain, by contacting the Seller directly, within a reasonable time taking into account the nature of the good, repair (if possible), replacement of the product, reduction of the price or termination of the contract.In any case, the use of the good that does not conform to the proper one established by the Seller/Manufacturer is not covered by the warranty.Any claim must be made by mentioning the proof of purchase (tax document issued by the seller/payment).
    2. 8.2 Manufacturer’s Commercial WarrantyThe Manufacturer issues a factory warranty (commercial warranty), which may be contained in the package.This warranty does not affect the consumer’s unavailable rights to it arising from statutory regulations.
    3. 8.3 Place of Submission of ComplaintsComplaints shall be submitted by the Buyer promptly and never later than 60 days from the date on which he/she discovered the lack of conformity. During this period the product cannot be used. The claim is forwarded electronically to the Seller who will immediately notify the Buyer of the point of service and the means by which to deliver the product.   • 9. Product LiabilityThe BLACK S.r.l. shall be liable in respect of damage to the product itself, not for collateral damage caused by the product.

  • 11. Applicable law and place of jurisdiction
    1. 11.1 The applicable law is that of Italy.
    2. 11.2 Any dispute, arising out of or in any way related to these “General Terms and Conditions of Sale” shall be referred to the jurisdiction of the Court as defined by the rules contained in the Consumer Code (Legislative Decree No. 206 of September 6, 2005). If relations between the Parties are between Professionals, the competent Court shall be that of Turin.
  • 12. Concluding Provisions Should any of these general terms and conditions prove invalid or become invalid at a later date, this shall not affect the validity of the remainder of this contract. In such a case, the invalid term is replaced with a term that most closely represents its economic intent and purpose or with the appropriate legal provisions. RIGHT OF RETURN AND WITHDRAWAL

For any reason not satisfied with the purchase made, the Buyer shall have the right to withdraw from the Contract, without penalty and specifying the reasons in the Return Form, within 15 working days from the date of delivery of the order.

The Buyer may exercise the right of withdrawal, within the above terms, through the procedure specified below, and only after filling out the Return Form, so as to obtain the corresponding Return Merchandise Authorization (RMA) Code.

The Products must be returned in the same condition as received, namely in perfect condition, complete with all their elements, unused, provided with the original packaging and any attached manuals.

It is understood that the risks of transportation for the return of the Products will be fully borne by the Buyer.

Seller will take delivery of the returned Products reserving the right to determine that the Products have been returned as delivered to Buyer. To this end, it will be appropriate to cover the original wrapping of the Products with other protective packaging that preserves their integrity and also protects them from writing or labels.

The Seller will refund to the Purchaser the full amount paid for the purchase of the Products by means of a purchase voucher to be spent on the site, excluding transportation contributions, within the time provided by the legal provisions, and provided that the Products have been returned in accordance with the above provisions.

DEFECTIVE PRODUCT

The Buyer shall have the right to return any Product it may have received defective within 10 days after the defect is found.

The Seller will take delivery of the defective Products reserving the right to carry out quality checks to verify the actual non-conformity.

In the event of a verified non-conformity, the Seller will reimburse the Buyer for the costs incurred in returning the defective Product, replace the Product with an equivalent, or refund the purchase price including shipping costs.
The aforementioned refund will be made by re-crediting or returning the amounts paid by the Buyer for the purchase of the products depending on the payment method used.
